Terms and conditions of sale

The following sales conditions are entered into, on one hand, by the company LAUN with a share capital of €1,000.00, headquartered in Paris, registered with the Paris Trade and Companies Registry under number 890 578 727, hereinafter referred to as "AUM," and managing the website AUM., and on the other hand, by any natural or legal person wishing to make a purchase through the AUM website., hereinafter referred to as "the buyer."

Article 1. Application of the Terms and Conditions

These sales conditions aim to define the contractual relationship between AUM and the buyer and the conditions applicable to any purchase made through the AUM website. The customer must become aware of the terms and conditions prior to any order ("the Order"), as the terms and conditions are available on the website. The acquisition of a product through this website implies an unconditional acceptance by the buyer of these sales conditions, which the buyer acknowledges having read prior to placing the order. AUM reserves the right to adapt or modify these terms and conditions at any time. The version of the terms and conditions applicable to any sale is the one posted online at at the time of the order. Consequently, placing an order requires the customer's full prior and unconditional acceptance of the terms and conditions by clicking the "I have read and accept the general terms of sale" button.

Article 2. Website Information and Accessibility is an e-commerce website owned and operated by the company SAS LAUN. The website is accessible to all internet users 24/7, except for scheduled or unscheduled interruptions by AUM. for maintenance, security, or in cases of force majeure. AUM. cannot be held responsible for any damage, of any nature, resulting from the unavailability of the site. AUM. does not guarantee that the site will be free of anomalies, errors, or bugs, nor that it will operate without breakdowns or interruptions. AUM. also cannot be held responsible for data transmission problems, connection issues, or network unavailability. AUM. reserves the right to make changes to the website for technical or commercial reasons. When these changes do not substantially and negatively affect the conditions of service provision, the customer may be informed of the changes, but their acceptance is not required.

Article 3. The Customer

AUM. products (hereinafter referred to as "Products") are exclusively intended for sale to final individual consumers or non-professional corporate clients (hereinafter referred to as "Customers"), excluding all resellers or intermediaries acting on behalf of resellers. Therefore, the Customer affirms that they are acting as a final consumer and do not intend to resell the Products for commercial purposes. The Site's customer must be an adult natural person with legal capacity. The customer, when placing their first order on the Site, must create a customer account and fill out an order form with certain mandatory fields (delivery address, phone number, etc.) so that their product order can be processed and validated by AUM. The information provided to AUM. when opening a customer account or when placing orders must be complete, accurate, and up-to-date. AUM. may, if necessary, request confirmation of this information and the customer's identity by any means. Considering the commercial policy described above, AUM. reserves the right to not process orders from individuals who do not qualify as "Consumers" or orders that do not conform to its commercial policy.


Article 4. Registration on the Website

To place an order, the Customer must first register on the website by creating an account containing the Customer's information (the "Account"). The Customer's registration on the website is validated by AUM. after verifying the standard form filled out by the Customer. The Customer receives a confirmation email upon registration. When creating their Account, the Customer must ensure the accuracy and completeness of the data provided. The Customer is responsible for keeping their personal information up to date. In the event of an error in the recipient's address details, AUM. cannot be held responsible for the inability to deliver Products. The account creation section is accessible directly from the side menu bar. During each visit, the buyer, if they wish to place an order or check their account (order status, profile, etc.), must log in using this information. By registering on the website, the Customer declares and guarantees to AUM. that they are of legal age and have the legal capacity to contract. AUM. can delete the Customer's Account at any time, for any reason, at its sole discretion.

Article 5. Products

The products offered for sale are those listed on the website on the day the Customer consults the site. The products offered are those listed on the AUM. website of the company AUM., subject to stock availability. The company AUM. reserves the right to modify the assortment of products at any time. It is possible that the Customer may receive a product that has been previously returned by another person. It is specified that AUM. only accepts the return of intact and unworn Products, with both conditions checked before restocking returned Products. Each product is presented on the website with a description that includes its main technical characteristics. The website does not sell used, defective, or lower-quality products than those available on the market. We draw the Customer's attention to the fact that the photographs illustrating our products may appear slightly different from reality due to the Customer's screen settings and lighting during photography. Furthermore, as these are artisanal creations, the items may have finishing irregularities, differences in size, and/or shades inherent to this type of production, which cannot be considered major defects. The Company's responsibility cannot be challenged, and the validity of the order cannot be affected. The photographs, graphics, and descriptions of the products offered are as accurate as possible but do not bind the Seller in any way. The sale of products presented on the AUM. website is intended for all buyers residing in countries that fully allow the entry of these products into their territory.


Article 6. Ordering and Payment Terms

Ordering on the website is subject to compliance with the procedure established by AUM. on the website, which includes successive steps leading to order validation. The company AUM. offers the buyer the option to order and pay for products in several stages:

Secure payment by credit card (via the Paypal system): The buyer selects the products they wish to order in the "cart," makes any necessary modifications (quantities, references, etc.), verifies the delivery address or provides a new one. Then, shipping costs are calculated and presented to the buyer, along with the name of the carrier. The next step allows the buyer to review all the information, acknowledge and accept these general terms and conditions of sale by checking the corresponding box, and then prompts them to confirm their order by clicking the "Confirm my order" button. Finally, the buyer is redirected to the secure Paypal interface to safely enter their personal credit card details. If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use, the buyer may request the cancellation of the credit card payment, and the amounts paid will be credited or refunded. The cardholder's liability is not engaged if the disputed payment was made fraudulently and proven, remotely, without physical use of the card. To obtain a refund of the fraudulent debit and any bank charges that the transaction may have incurred, the cardholder must contest the charge in writing with their bank within 70 days of the transaction, or up to 120 days if the agreement with the bank allows for it. The amounts debited will be refunded by the bank within a maximum of one month after receiving the cardholder's written dispute. No fees for the return of funds shall be charged to the cardholder. The confirmation of an order implies the acceptance of these sales conditions, the acknowledgment of having full knowledge of them, and the waiver of any own purchase conditions. All data provided and the recorded confirmation will constitute proof of the transaction. Article 7. Refusal to Process an Order

AUM. reserves the right to withdraw any Product displayed on the Website at any time and to replace or modify any content or information on the Website. Despite AUM.'s best efforts to meet the expectations of its customers, there may be circumstances in which AUM. is required to refuse the processing of an Order after sending the Customer the confirmation email summarizing the Order. AUM. cannot be held responsible to the Customer or any third party for the detrimental consequences of removing a Product from the Website, or for replacing or modifying any content or information on the Website, or for refusing to process an Order after sending the confirmation email summarizing the Order. AUM. also reserves the right to refuse or cancel an order from a Customer with whom they have a dispute regarding the payment of a previous order or when there is objective suspicion of fraud.


Article 8. Pricing

The prices listed on the product pages of the online catalog are in Euros (€) and include all taxes (VAT) applicable on the day of the order. Any change in the VAT rate may be reflected in the product prices. The company AUM. reserves the right to modify its prices at any time, with the understanding that the price listed in the catalog on the day of the order will be the only applicable price to the buyer. The prices indicated do not include delivery charges, which are billed in addition to the price of the purchased products, based on the total amount of the order. In mainland France, for any order equal to or exceeding 120 euros including VAT, shipping costs are waived; for any order below 120 euros including VAT, a flat fee for shipping costs will be charged to the buyer, with the amount varying depending on the weight and chosen delivery method, ranging from 6 to 18 euros including VAT.


Article 9. Retention of Ownership

The company AUM. retains full ownership of the products sold until full payment, including principal, fees, and taxes.

Article 10. Right of Withdrawal

Pursuant to Article L221-18 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for a refund without penalty. For hygiene reasons, we do not accept returns for lingerie. Art. L 21-21-8. The right of withdrawal cannot be exercised for contracts: "For the supply of goods that have been unsealed by the consumer after delivery and that cannot be returned for reasons of hygiene or health protection." Beyond this period of fourteen (14) days, the sale is final and binding. The Product must be returned in its original packaging, in its original condition, new, unworn, and unwashed. To initiate a return, the Customer must follow the procedure indicated on the return form received with their Order. The refund of the order by AUM. is made no later than fourteen (14) days from the date on which it is informed of the Customer's decision to withdraw. However, the refund is subject to AUM. having been able to retrieve the Products subject to the return and refund request. AUM. processes the refund using the same means of payment that was used for the payment of the order, unless the Customer expressly agrees to a different method. If this means of payment has expired, the Customer must contact customer service to change the refund method, which does not result in any additional cost for the consumer. AUM. cannot be held responsible for refunds to an expired payment method. The refund for an order paid with a gift card or credit will be automatically refunded as a credit. In the event of the Customer's non-compliance with these Terms and Conditions, AUM. will not be able to proceed with the refund of the affected Products. In all cases, return costs are borne by AUM. if the Product delivered to the Customer is different from the one ordered or if it is delivered damaged.


Article 11. Delivery

Deliveries are carried out by Chronopost or Colissimo services, from Monday to Saturday, depending on the option chosen by the Customer when placing their Order. Delivery refers to the transfer of physical possession of the Products to the Customer ("Delivery"). The Delivery charges applicable to the Order are those mentioned on the Website at the time of the order in the "Delivery and Lead Times" section. Delivery is made to the delivery address provided by the Customer, provided that it is the Customer's residence address, the address of a natural person of their choice, or the address of a legal entity (delivery to their company). Delivery cannot be made to hotels or post office boxes. Orders are fulfilled by Colissimo or Chronopost, delivery services with tracking, and may be handed over with or without a signature. Delivery times are provided for information purposes only; if they exceed thirty days from the order, the sales contract may be terminated, and the buyer refunded. The company AUM. may provide the buyer with the tracking number of their package by email. The buyer is delivered to their home by their mail carrier. In the event of the buyer's absence, they will receive a delivery notice from their mail carrier, allowing them to pick up the ordered products at the nearest Post Office, within a time frame indicated by postal services. When AUM. is responsible for the shipment of the Product, the risk of loss or damage to the Product is transferred to the Customer upon Delivery. As an exception, the risk is transferred to the Customer upon the handover of the Product to the carrier when the carrier is engaged by the Customer, not by AUM. The risks associated with transportation are the responsibility of the purchaser from the moment the items are physically received by them. The buyer is required to check the condition of the packaging and its contents at the time of delivery in the presence of the postal worker or delivery person (or within 10 days from receipt to file a complaint with the delivery service). In case of damage during transportation, any protest must be made to the carrier within three days from the date of delivery. In order for these deadlines to be met, the Customer must ensure that they have provided accurate and complete information regarding the Delivery address (such as street number, building, staircase, access codes, intercom names and/or numbers, etc.). AUM. cannot be held responsible for delivery delays that are not its fault or justified by a case of force majeure (as defined below).


Article 12. Warranty

All products provided by AUM. are covered by the legal warranty as provided for in Articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it can be returned to AUM., which will take it back and refund it. All claims and refund requests must be made by postal mail to the following address: SAS LAUN – Lot 1674, 101, rue de Sèvres – 75006 Paris within thirty days after delivery.


Article 13. Liability

In the process of distance selling, AUM. is only bound by an obligation of means. AUM. shall not be liable for any damage resulting from the use of the Internet network, such as data loss, intrusion, viruses, service interruption, or other involuntary problems. The Customer acknowledges assuming all risks associated with any content downloaded or otherwise obtained through the use of the Site and agrees that they are solely responsible for any damage caused to their computer system or any loss of data resulting from the download of such content. AUM.'s liability with respect to any Product purchased on the Site is strictly limited to the purchase price of that Product. AUM. shall in no event be liable for the following losses, regardless of their origin: loss of income or sales, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of working time or management, damage to reputation, loss of opportunity, including the opportunity to order a Product, moral harm. The documents, descriptions, and information regarding the Products on the Site are not covered by any warranty, express or implied, except as provided by law.


Article 14. Intellectual Property

All elements of the AUM. website are and remain the intellectual property and exclusive property of AUM. No one is authorized to reproduce, exploit, or use in any way, even partially, elements of the website, whether they are in the form of photos, logos, visuals, or text.

Article 15. Personal Data

AUM. undertakes to preserve the confidentiality of the information provided by the buyer, which they may be required to transmit for the use of certain services. Any information concerning the buyer is subject to the provisions of Law No. 78-17 of January 6, 1978. In this regard, the internet user has the right to access, modify, and delete information concerning them. Article 16. Dispute Resolution

These distance selling terms and conditions are subject to French law. For all disputes or disputes, the consumer may refer to:
